Track Tots Ltd– Terms & Conditions
At Track Tots, our priority is creating a fun, safe and engaging environment for little ones and their grown-ups.
By booking a class, you agree to the following Terms & Conditions:
1. Booking & Payment
- All sessions must be booked in advance.
- Block and term bookings secure your child’s place in class.
- Full payment is required at the time of booking.
A 7-day cooling-off period applies to block or term bookings. Parents may request a full refund within 7 days of booking by contacting hello@tracktots.co.uk. After this period, bookings are non-refundable.
2. Missed Sessions
There are no automatic make-up sessions for missed classes.
No refunds or credits are given for non-attendance.
3. Parental Responsibility
Parents/carers must remain with their child at all times and are fully responsible for their child’s supervision and behaviour during sessions.
During open sessions, parents/carers accept full responsibility for the supervision, conduct and care of their child throughout the class and whilst on the premises where the session is taking place.
Please ensure your child wears appropriate footwear suitable for indoor physical activity, such as trainers or pumps.
4. Health & Safety
- No food containing nuts may be brought into class due to allergies.
- Parents/carers must inform Track Tots via hello@tracktots.co.uk of any allergies, medical conditions, additional needs or behavioural considerations prior to attending sessions. Track Tots cannot accept responsibility for issues arising from information that has not been disclosed in advance.
- Children must not attend sessions if they are unwell or have been unwell within the previous 48 hours, in order to help protect themselves, other families and staff.
If an accident occurs, please notify your class coach who will assist and provide access to first aid equipment.
5. Arrival & Security
For the safety and wellbeing of all families and staff, venue doors may be locked internally five minutes after the scheduled start time of each session.
A register will be taken at the beginning of every class.
Unfortunately, late arrivals may not be permitted entry once the session has commenced and doors have been secured.
6. Photography & Filming
Photographs are permitted; however, please seek permission from other adults if other children are included in your photos or videos. Direct permission must also be obtained before sharing any images or videos on social media.
Full-length video recordings of sessions are not permitted.
Track Tots often takes photographs for promotional purposes and social media. Written consent (including email or social media messaging consent) will always be obtained prior to use, or consent will be obtained at the point of class sign-up or booking.
7. Coaching Staff
We aim to keep the same coaches at your location throughout the term wherever possible. However, Track Tots reserves the right to make changes to coaching staff if required.
All Track Tots coaches are fully DBS checked, first aid trained and safeguarding trained.
8. Changes, Cancellations, Minimum Numbers & Circumstances Beyond Our Control
Track Tots reserves the right to cancel, amend or reschedule sessions where necessary.
If class numbers fall below the minimum required to operate a safe and enjoyable session, Track Tots reserves the right to reschedule that session. Parents/carers will be notified as soon as reasonably possible.
Track Tots shall not be liable for failure to deliver sessions due to circumstances beyond our reasonable control, including but not limited to:
- Venue closure
- Staff illness
- Government restrictions
- Weather emergencies
- Other unforeseen events
Where possible, reasonable measures will be taken to offer a refund, credit or alternative session date. This will be at the discretion of Track Tots and subject to the circumstances.
9. Behaviour Policy
Track Tots reserves the right to refuse entry or remove any participant whose behaviour is unsafe, disruptive or inappropriate. No refund will be issued in these circumstances.
Track Tots reserves the right to exclude any parent/carer or child, either temporarily or permanently, if their behaviour compromises the safety or wellbeing of other participants, parents, carers or staff.
10. Afterschool Sessions Delivered on School Premises
For afterschool sessions delivered on school premises, children will be brought to the session by a member of the teaching staff for their Track Tots session at the agreed collection point and time.
Parents/carers are responsible for ensuring that the school has given permission for their child to attend Track Tots and that accurate emergency contact details are provided at the time of booking.
At the end of the session, children must be collected promptly by a parent/carer or authorised adult.
Track Tots reserves the right to withdraw a child from afterschool sessions if their behaviour is unsafe, persistently disruptive or compromises the wellbeing of others.
Track Tots accepts responsibility for children only during the scheduled session time and while they are under the supervision of Track Tots staff.
11. Liability & Insurance
Participation in Track Tots sessions involves physical activity.
Parents/carers remain responsible for supervising their child at all times during open sessions.
Track Tots Ltd shall not be liable for any injury, loss or damage suffered during sessions except where caused by our negligence. Nothing in these Terms & Conditions limits or excludes liability for death or personal injury resulting from negligence, or any other liability that cannot legally be excluded.
Track Tots Ltd holds Public Liability Insurance cover of up to £1,000,000 and Professional Indemnity Insurance cover of up to £1,000,000.
12. Governing Law & Complaints
These Terms & Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Track Tots aims to provide a high-quality service and to resolve any concerns quickly and fairly. If you are dissatisfied with any aspect of our services, please contact us within 7 days of the session via hello@tracktots.co.uk so that we can work with you to find an appropriate resolution.
13. Amendments
Track Tots reserves the right to amend these Terms & Conditions at any time. The most current version will always be available on our website.
